I am interested in starting a social network. It vaguely resembles that of Myspace and Facebook. However, there is a social network that it resembles a great deal, right down to the very niche that I am targeting. With that, my questions are as follows:
What kind of legal action must I take to protect myself and this idea before I begin? Did the creators of Facebook and Myspace file for any kind of patent or copyright?
Secondly, am I infringing on someone elses idea? Or is it "may the best man win?" As I said, the social network that I want to create resembles one that is already in existance. It does not seem to be doing too well and I think that I could trump it. Much like Myspace and Facebook are very similar, mine would be similar to another, smaller network that I have discovered; is this ok?

I own a legal services business and lately social networking is the way to go along with my website of course. I just joined a social network specifically for attorneys, however what about facebook and twitter? Is there any reasons why one might be better than the other for my purpose? Do either have a search for occupation or attorney groups?

The best allegory for New Racism is the tradition of "turkey pardoning" in the United States. Every year since 1947, the National Turkey Federation has presented the US President with a turkey for Thanksgiving. Every year, in a show of ceremonial magnanimity, the President spares that particular bird (and eats another one). After receiving the presidential pardon, the Chosen One is sent to Frying Pan Park in Virginia to live out its natural life. The rest of the 50 million turkeys raised for Thanksgiving are slaughtered and eaten on Thanksgiving Day. ConAgra Foods, the company that has won the Presidential Turkey contract, says it trains the lucky birds to be sociable, to interact with dignitaries, school children and the press. (Soon they'll even speak English!)
